These Terms and Conditions (“Terms”) govern your access to and use of the website, member portal and related services operated by Jan Swaraaj Shiksha Evam Samajik Kalyan Samiti (“Jan Swaraaj Samiti”, “we”, “us”, or “our”). By accessing our platform, creating an account, or using any feature, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you must not use our services.
1. About Our Services
Jan Swaraaj Samiti is a social welfare organisation engaged in education (shiksha), community welfare (samajik kalyan) and blood donation initiatives. Our digital platform enables users to register, become members, manage family records, submit blood requests, pledge donations and access related community services. We act as a coordination platform and do not replace professional medical advice or hospital care.
2. Eligibility
- You must be at least 18 years of age to create an account
- You must provide accurate, complete and current information during registration
- You must have the legal capacity to enter into a binding agreement under Indian law
- Blood donor registration is subject to medical eligibility standards; registering on our platform does not guarantee that you are medically fit to donate blood
3. Account Registration and Security
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activity that occurs under your account
- You must verify your mobile number using the OTP sent to your registered email before logging in
- You must notify us promptly if you suspect unauthorised access to your account
- We may suspend or terminate accounts that violate these Terms or applicable law
4. Family Verification and Membership
- Certain features, including blood requests, require approved family verification and active lifetime membership
- You must submit truthful Family ID details and a valid family card image for verification
- We reserve the right to approve, reject or request re-submission of verification documents at our discretion
- Membership fees, once paid successfully through our payment gateway, are generally non-refundable except where required by law or explicitly stated by us
- Membership cards and identity cards issued through the platform are for Jan Swaraaj Samiti programmes only and must not be misused or forged
5. Blood Donation and Blood Requests
5.1 Donor registration
By registering as a donor, you express willingness to be contacted for blood donation coordination. Actual donation is subject to medical screening at an authorised blood bank or camp. We do not conduct medical tests through this website.
5.2 Blood requests
Members with active membership may submit blood requests for family members listed in their account. You agree that:
- All request details (hospital, patient, clinical information) are accurate to the best of your knowledge
- You have authority to share patient and family information for coordination purposes
- We will endeavour to connect donors and coordinate support but cannot guarantee availability of blood units or donors within a specific timeframe
- Emergency medical situations require immediate contact with hospitals and emergency services; our platform is not an emergency response service
5.3 No medical advice
Information on our website is for community welfare and coordination only. It does not constitute medical advice, diagnosis or treatment. Always consult qualified healthcare professionals for medical decisions.
6. Donations and Payments
- Donation pledges submitted through our website are expressions of intent; our team may contact you with payment instructions
- Online membership payments are processed by third-party payment gateways; you agree to their terms when completing a transaction
- We are not responsible for delays or failures caused by banks, payment networks or technical issues beyond our reasonable control
- Tax benefits, if any, depend on applicable laws and our registration status; we do not guarantee tax deductions unless explicitly communicated in writing
7. Acceptable Use
You agree not to:
- Provide false, misleading or fraudulent information
- Impersonate another person or misuse another user’s account
- Use the platform for unlawful, abusive, harassing or harmful purposes
- Upload viruses, malware or content that infringes intellectual property or privacy rights
- Attempt to gain unauthorised access to our systems, admin panel or other users’ data
- Scrape, reverse engineer or commercially exploit our platform without written permission
8. User Content and Documents
By uploading profile photos, family card images, messages or other content, you grant us a limited licence to store, display and use that content solely to operate and improve our services. You represent that you have the right to share such content and that it does not violate any law or third-party rights.
9. Intellectual Property
All website content, branding, logos, software and materials (except user-submitted content) are owned by or licensed to Jan Swaraaj Samiti. You may not copy, modify, distribute or create derivative works without our prior written consent.
10. Privacy
Your use of our services is also governed by our Privacy Policy, which explains how we collect and handle personal information. By using our platform, you consent to those practices.
11. Service Availability and Modifications
We strive to keep our platform available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any feature, temporarily or permanently, with or without notice. We may update these Terms from time to time; the revised version will be posted on this page with an updated date. Continued use after changes constitutes acceptance.
12. Disclaimer of Warranties
Our services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that blood will be arranged, that donors will be available, or that information on the platform is always complete or current.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Jan Swaraaj Samiti, its trustees, volunteers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of life, health, data, profits or goodwill arising from your use of our services. Our total liability for any claim relating to the platform shall not exceed the amount you paid to us for membership in the twelve (12) months preceding the claim, or ₹500, whichever is greater.
Nothing in these Terms limits liability that cannot be excluded under Indian law.
14. Indemnity
You agree to indemnify and hold harmless Jan Swaraaj Samiti from claims, damages, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the platform, or violation of any law or third-party rights.
15. Account Termination
You may delete your account through Security Settings. We may suspend or terminate access if you breach these Terms, submit fraudulent verification documents, misuse blood request features, or engage in conduct harmful to the organisation or community. Provisions that by nature should survive termination (including liability limits, indemnity and governing law) will remain in effect.
16. Governing Law and Disputes
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in the district where our registered office operates, unless otherwise required by applicable consumer protection law.
